Immediate Changes to Holiday Pay Legislation for Schools

Rules regarding holiday pay for term time only / part-year workers have changed. Is your school compliant?

Created specifically for education leaders by those who support them on a daily basis, this free webinar will provide a vital update on new Regulations brought into force on 1 January 2024 following the consultation that stemmed from the Harpur Trust v Brazel case.

25 January at 9.30 -10.30am

Overview

Following the case of Harpur Trust v Brazel (which saw a teacher who worked term time only bring a claim against her employer for underpaying her holiday pay), the government launched a consultation on proposals to pro-rata holiday entitlement for part-year and irregular hours workers based on the annual hours they work. This resulted in new Regulations which came into effect on the 1 January 2024.

Join our Education Breakfast Briefing this January to discover what the new rules require and how you may decide to approach this.

What's on the agenda?

During this 60-minute session, we will explore what changes are effective immediately, including the right to receive “normal pay” for the four weeks of basic leave, and rights around carrying over leave in certain circumstances. We will then look at the changes to holiday entitlement for part-year and irregular-hours workers, which will apply to leave years starting on or after 1 April 2024.

Hosted by our Head of Education Team and Solicitor, Jane Hallas, join us to learn:

  • The background: The widely-debated Harpur Trust v Brazel case and the government’s subsequent consultation.
  • Approved methods: Changes on how to calculate Holiday Pay and entitlement for term-time / part-year workers.
  • Key changes: The changes effective from 1 January 2024, including the right to receive “normal pay” and when leave can be carried over.
  • When they apply: Holiday entitlement for workers whose leave year begins on or after 1 April 2024.
