Overview

On 8 November 2024, the government introduced draft regulations which will overhaul holiday pay and entitlement yet again. Described as the greatest changes to holiday pay since the Working Time Regulations were introduced, the new provisions will allow employers to calculate leave entitlement for irregular hour and part-year workers on a percentage basis, using the previously widely-utilised 12.07% calculation method. In addition, it will be possible for employers to roll up holiday pay.

Regulations governing aspects of TUPE and amendments to the Equality Act 2010 have also been laid down and are proposed to come into effect on 1 January 2024.

These latest changes follow a busy year of enhancements to workers’ rights, with no fewer than five new employment Acts, designed to fortify family-friendly rights, already announced earlier this year. Many of these Acts take effect in 2024, so if they have passed you by, now is the time to get clued up.

  • Reforms to holiday pay and entitlement: Get up to speed on recent developments, including the latest approved methods for calculating annual leave and holiday pay and changes to record-keeping requirements under the Working Time Regulations 1998 (WTR).
  • Equality Act 2010 amendments: Learn more about the draft legislation to amend the Equality Act coming into effect from 1 January 2024, which will preserve certain EU-derived equality rights and for establishing an equal pay comparator.
  • Changes to family-friendly rights: Get a helpful summary of several new Acts introduced in 2023, encompassing extended redundancy protection for new parents, a week’s unpaid leave for carers, and additional leave and pay for employees with children receiving neonatal care.
  • TUPE changes for small businesses: Hear about recent adjustments to consultation requirements, specifically pertaining to businesses with fewer than 50 employees and transfers involving fewer than 10 employees.
  • Flexible working developments: Get acquainted with the Flexible Working Act, which will come into force next year, and learn how this impacts (and doesn’t impact) the way requests are dealt with.
  • Other significant changes expected in 2024: Get early insight into what lies ahead in employment law so that you’re not left scrambling.
