Consent, Restrictions and the New Deprivation of Liberty Test: What Care Providers Need to Know

WorkNest joined Care Management Matters to host a webinar on rights, restrictions and inspection readiness in care services.

After the Supreme Court judgment in June 2026, the Cheshire West “acid test” no longer decides on its own whether someone is deprived of their liberty. Providers now need to look at the person’s whole situation, including their wishes and any objections. WorkNest’s Julie Walton and Natasha Heasman explained what this means for your policies and current arrangements. They also covered how CQC checks Regulation 11 consent by comparing what people and staff tell inspectors with what your records and governance show.

The session drew on real Inadequate-rated inspection reports. It ended with three questions every leader should be able to answer about consent, restrictions and oversight.

Well-Led in the CQC Framework

Changes to how Well-led is assessed under the CQC’s single assessment framework have become a major focus for providers.

With inspectors placing greater weight on leadership, governance, and organisational culture, expectations around what constitutes effective leadership have evolved. As inspections increasingly use these areas to judge whether services are safe, effective, and sustainable, providers need to be clear on what is required in practice.
